  1. Acceptance of Terms

    By requesting an estimate, approving a quote, scheduling service, or paying an invoice, you (“Customer”) agree to these Terms & Conditions. If you are approving on behalf of a business or property owner, you confirm you have authority to bind that entity.
  2. Estimates and Quote Validity
    • Estimates are based on visible site conditions and the information available at the time of inspection, including the service address, project details, site history, and any notes or information provided by the customer.
    • Quotes are valid for 30 days unless otherwise stated.
    • Any additional work not listed in the quote is outside scope and requires written approval (a “Change Order”).
  3. Scope of Work and Change Orders
    • We will perform only the services listed in the approved quote/work order.
    • If site conditions or Customer requests require extra labor/materials (hidden roots, buried debris, unmarked irrigation lines, unmarked cable and utility lines, expanded bed size, etc.), we will notify you and provide pricing for approval before proceeding when reasonably possible.
    • Verbal approvals may be documented in writing (text/email/Jobber notes) and treated as authorization.
  4. Scheduling, Access, and Site Conditions
    • Access: Customer is responsible for providing access to the property/work areas at the scheduled time (gates unlocked, pets secured, vehicles moved, etc.).
    • Utilities & irrigation: Customer is responsible for disclosing known underground utilities, wiring, and irrigation lines and ensuring utilities are marked where required.
    • Weather delays: Weather, saturated ground, or unsafe conditions may require rescheduling. We will communicate the next available date/time.
  5. Customer Responsibilities (Plants, Watering, HOA, Permits)
    • Plants/materials care: If you purchase/install plants or sod through us, Customer is responsible for proper watering and care unless a separate maintenance plan is provided. (see warranty section)
    • HOA rules: Customer is responsible for HOA approvals/restrictions unless we explicitly agree in writing to obtain them.
    • Permits: If permits are required, responsibility is solely on the customer as stated on the quote.
    • Completion/Acceptance: Customer has 24–72 hours to report issues in writing after completion, otherwise considered accepted.
  6. Materials, Substitutions, and Availability
    • Materials/pricing can change due to supplier availability.
    • If a specified plant/material is unavailable, we may propose substitutions of similar style/quality, subject to Customer approval.
  7. Payments, Deposits, Late Fees, and Collections
    • Deposit: A deposit of 50% is due for installs / projects over $10,000 unless otherwise stated.
    • Schedule: Work will be scheduled upon receipt of signed contract.
    • Payment due date: Invoices are due Net 7 unless otherwise stated on the invoice.
    • Payment methods: We accept card/ACH/check/cash.
    • Returned payments: Returned/failed payments may be subject to a $75 plus any bank/processor fees.
    • Late fees: A one-time late fee of 5% will be added to balances more than 30 days past due.
    • Collections: Customer agrees to pay reasonable collection costs and attorney fees where permitted if the account becomes delinquent.
  8. Credit Card Payments and Chargebacks
    • A 3.5% credit card fee will be charged on top of invoice balance if paying with credit card.
    • To avoid a credit card fee please pay by alternate payment method (cash, check, Zelle, etc.)
    • If a customer pays by credit card, processing is handled through our payment processor.
    • Any chargeback or disputed payment may result in the balance becoming immediately due while the dispute is investigated.
    • We may provide documentation (photos, signed approvals, messages, timestamps) to respond to chargebacks.
  9. Cancellations and Rescheduling
    • Cancellations or rescheduling requests must be made by phone/email/text.
    • If we arrive and cannot perform work due to lack of access or site not ready, a $500 may apply at our discretion.
    • Cancellations made less than 48 hours before the scheduled service window may be charged a cancellation/rescheduling fee of %10 . Deposits for installs/projects are credited toward rescheduled projects unless otherwise stated in writing. If materials have been purchased or special-ordered, the customer is responsible for those costs.
  10. Work Quality, Warranty, and Limitations
    • We will perform work in a professional manner consistent with standard landscaping practices.
    • All plant material will not receive a warranty after install.
    • If the customer has Aussie Landscape Management maintenance services this warranty will be extended to 6 months.
    • What is not covered:
      • Plants in decline due to severe weather events or circumstances beyond our control such as hurricanes, tropical storms, tornadoes, freeze events, drought, water restrictions, fungal diseases, insects, wildlife, or failure to adhere to the recommended watering schedule.
      • Transplants of any kind
    • Hardscape/material warranties: Any manufacturer warranties apply where available; our labor warranty (if any) is 1 year and excludes damage from misuse, acts of nature, or third-party work.
  11. Property Damage and Limitation of Liability
    • We take care to avoid damage; however, landscaping work involves inherent risks (hidden irrigation lines, shallow utilities, shifting soil, etc.).
    • Aussie Landscape Management LLC is not responsible for privately owned or privately installed underground utilities, including (but not limited to) landscape lighting, irrigation components, dog fences, low-voltage wiring, cable/internet lines, or gas and water lines running from a meter/tank to the home. When digging or excavation is part of the work, we will request locates for public utilities prior to the scheduled start date when required. While we take reasonable care to avoid marked utilities, due to the nature of landscaping and excavation work, shallow or unmarked lines may be damaged. Customer is responsible for identifying and/or marking all private utilities and accepts responsibility for all repair costs related to private utilities. Unless specifically stated in writing, we are not responsible for damage to driveways, curbing, pavers, turf, irrigation components, or other surfaces caused by the normal use of equipment and vehicles needed to perform the work.
    • We are not responsible for pre-existing property issues, hidden conditions, or damage caused by factors outside our control.
  12. Photos, Documentation, and Marketing
    • Customer authorizes us to take photos/video of the work area for estimating, documentation, quality control, and warranty/claims support.
    • Marketing use: We may use non-identifying before/after photos for marketing (website/social) unless Customer opts out in writing before the job starts.
  13. Text Messaging and Promotions (SMS)
    • By providing your mobile number and opting in, you agree to receive service-related texts (scheduling, reminders, updates, invoices) and promotional texts (special offers/seasonal reminders). Message frequency varies.
    • Message and data rates may apply.
    • Opt-out: Reply STOP at any time to cancel texts.
    • Help: Reply HELP or contact us at info@aussielandscape.com.
    • We do not sell your mobile information, and we do not share SMS opt-in data/consent with third parties for marketing.
  14. Disputes, Governing Law, and Venue
    • These Terms are governed by the laws of Florida.
    • Customer agrees to attempt good-faith resolution (communication and reasonable opportunity to cure) before escalating.
  15. Changes to Terms

    We may update these Terms from time to time. The current version will be posted at aussielandscape.com/terms with the Effective Date above.
